By accessing or using Visa Path ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Visa Path provides a digital platform to assist individuals in organizing and preparing their visa applications for Brazil, including document management, checklist tracking, and optional advisor support.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You agree to:

• Provide truthful and accurate information
• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• Not share your account with others
• Be responsible for all activities under your account

4. Service Plans and Pricing

4.1 Available Plans

We offer the following service plans:

• Self-Guided Plan ($349): Complete platform access with document templates, validation, and email support
• Advisor-Assisted Plan ($999): Everything in Self-Guided plus dedicated immigration advisor and expert support

4.2 Payment

All payments are processed securely through Stripe. Prices are in USD and are subject to change with notice. Payment is required before accessing the full dashboard features.

4.3 Refund Policy

Due to the nature of our digital services and the immediate access provided upon payment, refunds are generally not available. However, we may consider refund requests on a case-by-case basis within 7 days of purchase if you have not substantially used the Service.

5. User Obligations

By using the Service, you agree to:

• Provide only authentic and accurate documents
• Not upload fraudulent, forged, or misleading documents
• Comply with all applicable immigration laws and regulations
• Not use the Service for any illegal purpose
• Not attempt to circumvent any security features
• Not interfere with or disrupt the Service

6. Document Upload and Storage

6.1 Your Documents

You retain ownership of all documents you upload. By uploading documents, you grant us a limited license to store, process, and display them as necessary to provide the Service.

6.2 Document Accuracy

You are solely responsible for the accuracy, legality, and authenticity of all documents you upload. We do not verify the authenticity of documents and are not liable for any consequences arising from inaccurate or fraudulent documents.

6.3 Document Expiration

While we provide expiration tracking features, you are ultimately responsible for ensuring your documents remain valid. We are not liable for any issues arising from expired documents.

7. Advisor Services

For users of the Advisor-Assisted Plan:

• Advisors provide guidance based on their experience and knowledge
• Advisor recommendations are not legal advice
• Visa outcomes cannot be guaranteed
• Response times may vary based on advisor availability

8. Intellectual Property

The Service, including its design, features, content, and functionality, is owned by Visa Path and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISA PATH SHALL NOT BE LIABLE FOR:

• Visa denials or delays by immigration authorities
• Loss of documents or data (though we implement reasonable safeguards)
• Incorrect information provided by users
• Changes in immigration laws or requirements
• Actions of third-party service providers
• Any indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Visa Path, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Visa Path regarding the Service.
